Terms of Use

Last updated: 16 August 2026

1. Introduction

These Terms of Use ("Terms") govern your use of the OTVERSE website and, when available, the OTVERSE VR application, subscriptions, and related services (together, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

The Service is operated by OTVERSE.AI Ltd, a company registered in Scotland under company number SC880448, with its registered office in Glasgow, United Kingdom.

2. Eligibility

The Service is intended for individuals aged 18 or over, particularly medical students, junior doctors, and healthcare professionals. By creating an account or using restricted parts of the Service, you confirm that you are at least 18 years old and legally capable of entering into these Terms.

3. Account registration

To access certain features, you may need to create an account. You agree to:

  • Provide accurate, current, and complete registration information.
  • Keep your login credentials secure and confidential.
  • Notify us promptly if you suspect unauthorised access to your account.
  • Take reasonable responsibility for activity carried out through your account.

We may restrict, suspend, or terminate an account where reasonably necessary because of a material or repeated breach of these Terms, unlawful conduct, security risk, or risk of harm to the Service or others.

4. The Service and medical disclaimer

OTVERSE provides VR surgical simulation for training and educational purposes.

  • The Service is not designed or intended to provide medical advice, diagnosis, treatment, or patient-specific clinical decision-making.
  • The Service supplements and does not replace supervised clinical training, professional judgement, institutional protocols, or applicable professional standards.
  • Simulation scores and feedback provide educational guidance only and do not constitute professional certification or a clinical assessment of competence.
  • Although we take reasonable care in developing the simulations, simulated scenarios may not reproduce every aspect, risk, or variation of a real procedure.

You must not use the Service to diagnose or treat a patient or as the sole basis for performing a clinical procedure.

5. Subscriptions, payments, and cancellation

We may offer free and paid access. The features, current price, billing interval, taxes, and any minimum term will be displayed before you purchase. Indicative paid plans may range from £15 to £50 per month, but the price shown at checkout will apply to your purchase.

If you subscribe through the Meta Quest Store or another third-party store, its payment, renewal, cancellation, and refund terms also apply. If you subscribe directly through OTVERSE:

  • Your subscription will renew at the stated interval until you cancel it.
  • You can cancel through your account settings or the cancellation method shown at purchase. Cancellation normally takes effect at the end of the current paid billing period.
  • We will provide advance notice of a price increase that affects an existing subscription. You may cancel before the new price takes effect.
  • Refunds and cancellation rights are provided where required by applicable consumer law. Nothing in these Terms limits those statutory rights.

Where digital content or services begin during a statutory cancellation period, we will request any express consent or acknowledgement required by law before that access begins.

6. Intellectual property

The Service, including its software, 3D models, simulations, scoring systems, interface designs, text, graphics, logos, and trademarks, is owned by or licensed to OTVERSE.AI Ltd and is protected by applicable intellectual-property laws.

We grant you a limited, personal, non-exclusive, non-transferable, and revocable right to use the Service for its intended educational purpose while you comply with these Terms. Unless permitted by law or with our prior written permission, you must not:

  • Copy, modify, distribute, sell, sublicense, or create derivative works from the Service.
  • Reverse-engineer, decompile, or attempt to extract source code or underlying assets.
  • Remove ownership notices or use our trademarks, logos, or branding.
  • Use the Service commercially, except under a separate written agreement with us.

7. Acceptable use

You must not:

  • Use the Service unlawfully or to infringe another person's rights.
  • Attempt to gain unauthorised access to the Service, systems, data, or another user's account.
  • Interfere with, overload, disrupt, damage, or introduce malicious code into the Service.
  • Share account credentials, impersonate another person, or misrepresent your identity or affiliation.
  • Scrape, probe, test, or circumvent access, security, usage, or technical restrictions except where expressly permitted by law.

8. Personal data and privacy

Our Privacy Policy explains how we collect and use personal data in connection with the Service. It is provided for transparency and does not rely on your agreement to these Terms as consent for data processing. Where consent is legally required, we will request it separately.

9. Availability and warranties

We aim to provide the Service with reasonable care and skill, but availability may occasionally be interrupted by maintenance, updates, technical problems, or events outside our reasonable control. We do not promise that every feature will always be available or that the Service will be entirely error-free.

To the extent permitted by law, no additional warranties are given beyond those expressly stated in these Terms. Nothing in these Terms affects warranties, remedies, or other rights that cannot lawfully be excluded, including applicable consumer rights.

10. Limitation of liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. We are not responsible for losses that are not foreseeable, were caused by inaccurate information or misuse of the Service, or are business losses arising from consumer use.

If you use the Service wholly for business purposes, our total aggregate liability arising from the Service will not exceed the greater of £100 or the amount paid by you to OTVERSE for the Service during the 12 months before the event giving rise to the claim, except where liability cannot lawfully be limited. We are not liable to business users for indirect or consequential loss, loss of profit, revenue, business, opportunity, or anticipated savings.

11. Responsibility for misuse

You are responsible for losses reasonably incurred by us as a direct result of your deliberate unlawful use of the Service or material breach of these Terms. If you use the Service wholly for business purposes, you agree to indemnify OTVERSE against third-party claims arising directly from that unlawful use or material breach, except to the extent caused by OTVERSE. This section does not require a consumer to compensate us beyond what is permitted by applicable law.

12. Changes to or discontinuation of the Service

We may update, improve, suspend, or discontinue features for operational, technical, security, legal, or business reasons. Where a change materially reduces a paid Service, we will provide reasonable advance notice where practicable and any remedy required by law. If a material change takes effect during a prepaid period, you may have a right to cancel and receive an appropriate refund for the affected unused period.

13. Changes to these Terms

We may revise these Terms for legitimate reasons, including changes to the Service, law, security, or our business. We will post the revised Terms, update the "Last updated" date, and give reasonable advance notice of material changes where practicable. If a material change applies to an ongoing paid subscription and you do not accept it, you may cancel before it takes effect. Changes will not remove rights or remedies that have already arisen.

14. Suspension and termination

You may stop using the Service at any time and may cancel a subscription as described above. We may suspend or terminate access where reasonably necessary because of a material or repeated breach, unlawful conduct, non-payment, a serious security risk, or risk of harm. Where appropriate, we will give notice and a reasonable opportunity to remedy the issue. We may act immediately where urgent action is reasonably necessary.

On termination, your right to use the Service ends. Provisions which by their nature should continue—including intellectual property, accrued payment obligations, liability, and dispute provisions—will survive. Termination does not affect rights or remedies that arose beforehand.

15. Governing law and courts

These Terms are governed by Scots law. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of the country in which you normally live, and you may bring proceedings in any court available to you under applicable law. If you use the Service wholly for business purposes, the Scottish courts will have exclusive jurisdiction.

16. Severability and waiver

If any provision of these Terms is found to be unlawful or unenforceable, it will be treated as modified to the minimum extent necessary or removed, and the remaining provisions will continue in effect. A delay in enforcing a right does not waive that right.

17. Contact

If you have questions about these Terms, contact OTVERSE.AI Ltd, Glasgow, United Kingdom, at umer@otverse.ai or harshil@otverse.ai.
